Strengthen your organization’s data privacy framework with structured assessment and advisory aligned with India’s Digital Personal Data Protection Act (DPDPA), GDPR, PDPA, LGPD, CCPA, and other applicable privacy requirements.

Eagle’s Data Privacy Compliance Advisory service helps organizations understand their applicable privacy practices, identify compliance gaps, and help implement practical measures to improve data handling, protection, retention, access, and privacy governance framework.

Why is data privacy important?

In an era where your personal information is as valuable as cash, data privacy is the ultimate shield that keeps your identity, finances, and freedom safe from digital threats. Without strict privacy measures, everyday details like your banking info, health records, and private messages are left exposed to cybercriminals and unauthorized tracking, leading to identity theft, financial fraud, and invasive surveillance.

DPDP Act Implementation Timeline

13 November 2026 – Consent Manager Registration Starts: Platforms that manage user consent can begin registering with the Data Protection Board.

13 May 2027 – Full Rules Take Effect: All main rules become compulsory, including proper consent notices, data security, fast breach reporting, and respecting user rights.

Act deadlines for your business.

Frequently Asked Questions?

1. What happens if my organization is not DPDP-ready?

Non-compliance can expose your business to regulatory penalties, reputational damage, loss of customer trust, and operational disruption. The Act provides for significant financial penalties, so an early readiness assessment is advisable.

2. What are the penalties for non-compliance?

Penalties can reach ₹250 crore for failing to take reasonable security safeguards, and ₹200 crore each for failing to report a personal data breach and for breaching children's data obligations. Significant Data Fiduciaries may face penalties of up to ₹150 crore for breaches of their additional obligations, while other breaches can attract penalties of up to ₹50 crore. The Data Protection Board determines the penalty based on the nature and seriousness of the violation.

3. What does Eagle’s DPDP Compliance Advisory include?

Our advisory helps you assess and improve readiness across key DPDP areas, including:

  • Data discovery, classification, and processing mapping
  • Consent collection and management
  • Privacy notices and customer communication
  • Data retention and deletion practices
  • Vendor and third-party risk review
  • Security controls and data loss prevention
  • Breach response readiness
  • Data Principal request handling

These are core operational areas businesses need to address under the DPDP framework, as applicable to their circumstances.

4. Do we need a DPDP compliance assessment if we already have a privacy policy?

Yes. A privacy policy is only one part of a broader privacy compliance program. Organizations should also evaluate how personal data is collected, processed, stored, shared, retained, and protected, as well as whether appropriate processes exist for consent, rights requests, grievances, and applicable breach-related obligations.

5. If we are already ISO 27001:2022, are we automatically DPDP compliant?

No. While frameworks like ISO 27001:2022 provide a strong foundation, the DPDP Act introduces specific obligations unique to Indian law—such as distinct consent manager frameworks, mandatory local breach notification protocols, and specific provisions regarding Significant Data Fiduciaries (SDFs). Our advisory maps your existing certifications to fill these localized legal gaps efficiently.

6. What must I do if there is a data breach?

Under the DPDP framework, Data Fiduciaries are required to notify the Data Protection Board of India and affected individuals about personal data breaches, in accordance with applicable rules. Your incident response plan should support timely notifications and any required follow-up information.

7. What does a valid consent notice need to include?

Consent must be free, specific, informed, unconditional, and given through a clear affirmative action. The notice should use clear and plain language, explain what personal data is collected and why, describe how consent can be withdrawn, and explain how to raise a complaint with the Data Protection Board of India. Withdrawing consent must be as easy as giving it.

8. Am I responsible for what my vendors do with personal data?

Yes. As the Data Fiduciary, your organization remains responsible for processing personal data carried out on its behalf, subject to applicable law. You should establish appropriate contractual terms with data processors and review the measures they use to protect personal data.

9. What does the assessment cover?

The assessment covers five key areas:

  • Your privacy compliance practices
  • How you collect, handle, and process personal data
  • Who can access personal data and how it is protected
  • How long personal data is retained and how it is deleted
  • Privacy governance, including roles, standard operating procedures (SOPs), and vendors
10. Do you only advise, or can you help implement?

Both. The assessment provides a prioritized roadmap, and Eagle's team can help implement practical measures such as access controls, retention automation, and consent mechanisms, depending on your organization's requirements.

11. Will you keep our information confidential?

Yes. We work under a non-disclosure agreement (NDA) and access only the information needed for the assessment.

12. How do I get started with DPDP compliance?

Start with a DPDP compliance assessment to understand your current position and identify priority gaps. Eagle can assess your organization's data processing practices and help develop a practical roadmap for addressing applicable DPDP requirements.
